Frequently Asked Questions

Yes, any swimming pool or spa (including above‑ground or portable types) that holds more than 300 mm of water requires a building permit, as does any safety barrier installation or alteration to an existing pool / spa, before construction begins.

Pools must have a safety barrier that complies with Australian Standard AS 1926.1 (barrier performance) and AS 1926.2 (barrier location), as referenced in the National Construction Code (NCC).

  • Reviewing your plans to identify any non‑compliance issues.
  • Assessing and lodging the building permit application.
  • Coordinating mandatory inspections, including barrier inspections.
  • Issuing the final inspection certificate and Form 23 for pool registration with your Council.

After completion of the mandatory notification stage, the builder is to contact Conti Group for the inspection booking. Noting that we aim to schedule most mandatory inspections within 48–72 hours depending on location / availability. With respect to general inspections including Form 23 inspections we can carry these out generally within 5 – 7 days of booking the inspection with our office.

Yes, registration is separate from the building permit and Form 23. Even after obtaining the permit, final inspection certificate and Form 23, you (the property owner) still need to register the pool or spa with your Council under state regulations.

Failing to obtain a valid building permit, filling your pool or spa before the final certificate being issued or inspection or registering your pool or spa can result in significant fines, enforcement notices, and potential legal action from your local council in Victoria.

Once registered, your pool/spa must be inspected every 4 years, and a new compliance certificate (Form 23) submitted to Council.
